SCHUYLER — A 27-year-old Schuyler man was sentenced last week to four months in jail in connection with an April 2016 fatal crash.
The sentence handed down Jan. 24 to Jesus Vasquez De La Cruz follows a recommendation from the Colfax County Attorney’s Office, which reached a plea deal with the defendant. He was also ordered to pay $5,000 in restitution.
Authorities say Vasquez De La Cruz was intoxicated when the 1999 GMC Sierra extended-cab pickup he was driving rolled down an embankment along County Road 10 northwest of Schuyler.
Vasquez De La Cruz and a passenger in the vehicle, 24-year-old Moises Aguilar-Aguilar of Schuyler, were thrown from the pickup during the mid-afternoon crash. Both men were transported by ambulance to CHI Health Schuyler, where Aguilar-Aguilar was pronounced dead.
Vasquez De La Cruz, who had no prior criminal history, pleaded no contest to manslaughter in October.
That charge is a felony punishable by up to 20 years in prison. There is no mandatory minimum sentence.
"We have worked with the victim’s family and discussed with the family the various aspects of this criminal case," Colfax County Attorney Denise Kracl said in October.
Misdemeanor charges of driving under the influence of alcohol, reckless driving, no valid operator's license and unauthorized use of a propelled vehicle were dismissed in the case.
