COLUMBUS – A loud argument involving a transient couple from Hastings bickering at a local gas station in March is apparently going to wind up going to trial for both defendants in Platte County District Court.

Platte County Court Judge Frank Skorupa bound Marty Henry over for trial after the defendant waived his preliminary hearing on charges stemming from a report of a possible domestic assault.

Henry will go to trial on charges of possession of methamphetamine with intent to distribute, possession of a firearm while committing a felony and two other drug possession counts.

The judge scheduled the 37-year-old Henry for arraignment on the charges April 24.

Last month, the judge set 33-year-old Mary Argent for trial on counts of possession of methamphetamine with intent to distribute, possession of a firearm during the commission of a felony, possession of THC, tampering with evidence, possession of marijuana and possession of psilocybin (a natural hallucinogenic) stemming from the March 12 incident.

Henry was arrested at the same time as Argent shortly after 5 p.m. March 12 outside of a convenience store in the 800 block of East 23rd Street.

Both remain in the Platte County Detention Facility.

Henry and Argent each face charges that carry penalties of up to 50 years imprisonment.

A Columbus Police investigation began March 12 with a 911 call reporting a possible domestic assault with a male suspect yelling at a female passenger in a parked Chevrolet Impala. The male suspect, later identified as Henry, walked away just prior to officers’ arrival.

As officers approached the vehicle the odor of marijuana was detected, according to Officer Bradley Wangler’s probable cause arrest statement.

After refusing to allow officers to search the vehicle, Wangler wrote, Argent reached into the car, removed an item from the center console and threw it in the trash can. Officers retrieved glass pipe that contained a white crystal substance that later tested positive for meth.

During a subsequent search, officers seized a lock box that contained 46 grams of meth, a digital scale and cash. A 9mm Keltec handgun was found in a bag on the passenger floorboard and a loaded magazine was discovered in the center console.

Henry was arrested by officers as he was walking back to the car from a nearby store.
